1. Acceptance of Terms
By ordering, registering an account, accessing, or using Proficia360 (the “Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you must not use the Service. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the updated Terms.
If your organisation has a signed agreement with us (a pilot agreement, Master Services Agreement, or signed Order Form) that conflicts with these Terms, the signed agreement prevails for your organisation for the term it covers.
2. Description of Service
Proficia360 is a graph-powered talent intelligence and skills management platform operated by Tunjang Jaya Graftek Sdn Bhd (“we”, “us”, or “our”).
The Service allows an organisation to build one connected model of its hierarchy, positions, and job roles; define skill taxonomies with proficiency levels, behaviours, and evaluation prompts; run skills-based assessments; and explore coverage, capability gaps, growth readiness, and workforce scenarios through dashboards and reports.
- A hosted web application, accessed over HTTPS, with a separate workspace per institution.
- The AICB Future Skills Framework and banking domain data pre-loaded so you start with a populated skills graph.
- Organisation hierarchy builder, role catalogues, and skills & proficiency designer.
- Assessment engine with evaluation templates, cycles, review queues, and reports.
- Live skills map, coverage and gap dashboards, and workforce planning views.
- A GraphQL API for building your own integrations, reports, and automation.
- Optional HRMS or LMS integration, and guided onboarding and configuration support.
3. Demonstration and Trial Stage
Proficia360 is offered for evaluation through a hosted demonstration environment at demo.proficia360.com. A trial runs for two weeks from the date you register.
During this stage we may add, change, or retire features, and we describe the Service as it is offered at the time you order. Nothing labelled demonstration, preview, or beta is covered by the availability and support expectations in Section 15.
- The trial is for evaluation only. Use it to test the workflow with sample data, not to run your live assessment cycle.
- Do not enter real employee records or any sensitive personal data as defined by the PDPA. Use invented names, positions, and figures.
- Each trial workspace is private to the account that created it and is not reachable by other trial accounts.
- At the end of the two-week window we may reset or retire the workspace, so export anything you want to keep before then.
- Your trial of the demonstration environment is provided without charge and creates no commitment on either side.
To move from trial to production, write to us using the contact details in Section 23. We scope the deployment with you — standard or customised platform set-up, assessment seats, and any integration — and a commercial engagement is then governed by these Terms together with your signed Order Form or Master Services Agreement.
4. Who May Use the Service
The Service is licensed to an institution (“you” or “your organisation”) and is used by named people your administrators provision. By placing an order you represent that you are authorised to bind your organisation and that your organisation has the legal right to submit and process the employee data it uploads.
- Every account belongs to one person. Do not share credentials or let several people use one login.
- Your administrators control who has a seat, what role they hold, and what data they can see.
- Users must be employees or engaged contractors of your organisation and at least 18 years old.
- You are responsible for all activity carried out under the accounts you provision.
5. Plans, Fees and Pricing
Pricing published on this website (see the Pricing section of the home page) is made up of three components.
Fees are quoted in Malaysian Ringgit (MYR) and exclude applicable taxes, including sales and service tax where applicable, which are added to the invoice.
We may change our prices. A price change takes effect for a subscription only at its next renewal, and we notify your administrator by email at least 30 days before that renewal. A written quotation or Order Form signed by both parties prevails over the published price for the term it covers.
- Skills assessment subscription — RM 100 per user per year for a one-time assessment, or RM 200 per user per year for unlimited assessments.
- Platform set-up (one-off) — RM 12,200 per institution for the standard platform built on the Future Skills Framework, or RM 40,200 per institution for a customised platform aligned to your own architecture.
- Optional integration (one-off) — RM 30,990 per institution to connect an HRMS or LMS.
6. Ordering, Invoicing and Payment
Subscriptions, platform set-up, and integration work are ordered through a signed quotation, an Order Form, or a written confirmation to the Proficia360 team. We invoice in MYR.
Payment is due within the period stated on the invoice, or 14 calendar days from the invoice date where no period is stated. We accept bank transfer to the account shown on the invoice and, where offered, payment through a supported online payment provider. Platform set-up or integration work begins once the corresponding fee is settled or where your signed agreement says otherwise.
We may suspend access to the Service if an invoice becomes overdue, after giving notice and a reasonable opportunity to pay.
7. Term, Renewal and Seat Changes
Assessment subscriptions run for 12 months from the subscription start date. Subscriptions do not renew automatically: near the end of a term we contact your administrator, and the subscription continues only if you confirm the renewal or settle a new invoice.
You may add seats during a term at the then-current per-user price, charged pro-rata for the remaining months of the term. Reducing or deprovisioning seats does not create a refund, and seat counts are trued up at renewal.
8. Cancellation, Termination and Refund Policy
We do not issue refunds for voluntary cancellations. This section states exactly what that means for each type of fee, so there are no surprises.
Cancelling a subscription
You may stop renewing your subscription at any time by emailing the Proficia360 team from an authorised address. Cancellation takes effect at the end of the current 12-month term. You keep full access to everything you have paid for until the term ends, after which your workspace is deactivated in line with Section 16.
No refunds for unused time
Fees already paid are non-refundable. We do not provide prorated, partial, or full refunds for unused time within a subscription term, for unused or deprovisioned seats, or for a decision to stop using the Service. If you cancel mid-term, you retain access until the end of the period you have already paid for.
Platform set-up and integration fees
Set-up and integration fees are one-off professional services charges for configuration work scoped to your institution. They are non-refundable once project kick-off has taken place or any configuration work has begun on your behalf.
If you cancel in writing before kick-off and no work has started, the set-up or integration fee is refunded less any amount already incurred for you — for example third-party licences, data provisioning, and hours already spent.
Disputed invoices
If you dispute an invoice, tell us within 14 days of the invoice date and we will review it with you before treating it as overdue.
If we fail to deliver
Nothing here limits your rights where we fail to deliver. If we cannot deliver a material part of what we agreed, our first remedy is to complete or re-perform it at no additional charge. If that is not possible, we will agree an appropriate credit or refund with you in writing for the part we failed to deliver.
9. Acceptable Use
You agree not to:
- Use the Service for any illegal, fraudulent, defamatory, obscene, or abusive purpose.
- Upload data you have no right to collect or share, or knowingly store inaccurate or misleading employee records.
- Attempt to disrupt, overload, penetration-test without written permission, or gain unauthorised access to the Service or its infrastructure.
- Scrape, bulk export, or redistribute another organisation’s data, or other users’ information.
- Reverse engineer, decompile, or create derivative works of the platform.
- Remove or obscure attributions and notices, including those on third-party framework content.
- Use assessment outputs as the sole basis for an unlawful or discriminatory employment decision.
- Resell, sub-licence, or offer the Service to third parties as your own product without our written permission.
- Use bots or automated tools against the website or platform, except through documented API calls authenticated with your own organisation’s credentials.
10. Your Data, Content and Responsibilities
You own and remain solely responsible for all organisational and employee data you or your users submit to your workspace (“Your Data”). We host and process Your Data only to provide the Service to you, as described in our Privacy Policy.
- Give employees any notice and obtain any consent their personal data requires before uploading it.
- Keep Your Data accurate, lawful, and proportionate to the purpose you are assessing.
- Treat proficiency scores and assessment results as confidential internal HR information.
- Nominate and manage your administrators, and remove access promptly when people change role or leave.
- You are accountable for your users’ compliance with these Terms.
11. Third-Party Framework Content
The AICB Future Skills Framework and any other industry framework delivered with the platform remains the property of its owner and is made available to you as part of the Service for internal use within your organisation.
- Do not publish, sell, or share framework content outside your organisation.
- Do not remove or alter attribution notices on framework material.
- Your use must also comply with the framework owner’s licence terms where they apply to you.
12. Feedback
If you send us suggestions, ideas, or feedback about Proficia360, we may use them without restriction and without payment to you, provided we do not publish anything that identifies you or your organisation without your permission.
13. Intellectual Property
The Proficia360 name and logo, the software, interface design, skills graph models, and all associated intellectual property are owned by Tunjang Jaya Graftek Sdn Bhd. Your Data remains your property.
Nothing in these Terms grants you any right to our trade marks, or permission to copy, modify, distribute, or build derivative products from the platform, without our prior written consent.
14. Confidentiality
Each party may learn information about the other’s business, workforce, pricing, security arrangements, or roadmap that is marked confidential or should reasonably be understood to be confidential. Both parties will use such information only to perform under these Terms, protect it reasonably, and disclose it only to those who need it and are bound to keep it confidential.
This does not apply to information that is already public, was independently developed, is lawfully received from another source, or must be disclosed by law — in which case the disclosing party gives prompt notice where it is lawful to do so.
15. Availability, Support and Maintenance
We aim to keep the Service available and will give reasonable notice of scheduled maintenance through the workspace or by email.
Support is provided by email to the Proficia360 team. Response and resolution expectations depend on severity and on any support terms in your signed agreement. Unless a signed agreement states an availability figure, these Terms do not include a guaranteed uptime percentage.
16. Suspension and Termination
We may suspend or terminate access to the Service at any time if:
- we reasonably believe you have violated these Terms;
- an invoice remains overdue after notice;
- your continued use creates a legal, security, or reputational risk to us, the Service, or other institutions; or
- we are required to do so by law or by a regulator.
You may stop using the Service and cancel renewals at any time under Section 8.
On expiry or termination, we deactivate your user accounts, make Your Data available for export for 30 days if you request it within that window, and then delete or anonymise it as described in the Privacy Policy. Fees already paid remain non-refundable except where Section 8 states otherwise.
17. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Skills assessments, proficiency scores, gap analyses, and dashboards are decision-support tools for HR, People Ops, L&D, and line management. They are not legal, financial, medical, or employment advice, and they must not be the sole basis for hiring, promotion, discipline, redundancy, or termination decisions. Those decisions remain yours and should follow your own policies and applicable Malaysian employment law.
18. Limitation of Liability
To the maximum extent permitted by law, Tunjang Jaya Graftek Sdn Bhd shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profit, revenue, data, goodwill, or business opportunity, arising from your use of, or inability to use, the Service.
Our total liability for any claim arising from or relating to the Service shall not exceed the total fees paid or payable by you to us in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes or restricts liability that cannot be excluded or restricted under Malaysian law.
19. Indemnity
You will indemnify Tunjang Jaya Graftek Sdn Bhd against claims, losses, damages, and reasonable costs arising from your or your users’ breach of these Terms, from Your Data (including any claim by an employee or third party about how it was collected, used, or shared), or from your use of assessment outputs in an employment decision.
20. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of Malaysia, including the Personal Data Protection Act 2010.
Before starting proceedings, the parties will try to resolve a dispute in good faith for 30 days from written notice describing it. After that, disputes are subject to the exclusive jurisdiction of the courts of Malaysia.
21. Changes to These Terms
We may update these Terms from time to time. Changes are posted on this page with an updated revision date, and material changes are notified to your administrator by email before they take effect. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
22. General
- If any provision of these Terms is unenforceable, the remaining provisions continue in force.
- We do not waive a right by delaying or missing a single enforcement.
- We may assign these Terms in connection with a merger, acquisition, or reorganisation; you may not assign them without our written consent.
- Notices to you may be sent to the email addresses on your account; notices to us go to the contact details in Section 23.
- These Terms are the entire agreement about their subject matter and supersede earlier drafts, but not a signed agreement that states it prevails.
